The vote comes less than five months after Nazareth resident Will Cramer, represented by the Institute for Justice (IJ), filed a federal First Amendment\u00a0<a href=\"https:\/\/zwly9k6z.r.us-east-1.awstrack.me\/L0\/https:%2F%2Fij.org%2Fwp-content%2Fuploads%2F2024%2F04%2FECF-01-Complaint.pdf\/1\/010001912836ffa9-2a11de5c-e3dd-459f-9741-b034c6b48ad2-000000\/-4yE8QPq4vB6JWgSHBWxs30oOgk=386\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/zwly9k6z.r.us-east-1.awstrack.me\/L0\/https:%252F%252Fij.org%252Fwp-content%252Fuploads%252F2024%252F04%252FECF-01-Complaint.pdf\/1\/010001912836ffa9-2a11de5c-e3dd-459f-9741-b034c6b48ad2-000000\/-4yE8QPq4vB6JWgSHBWxs30oOgk%3D386&amp;source=gmail&amp;ust=1723043261854000&amp;usg=AOvVaw0eu_LtuTKJJORiQiMpcL0D\">lawsuit<\/a>\u00a0challenging the ban.<\/div>\n<div><\/div>\n<div>\u201cYesterday\u2019s decision to repeal this unconstitutional ordinance is a win for the First Amendment rights of all Nazareth residents,\u201d said IJ Litigation Fellow Bobbi Taylor. \u201cThe government cannot block people from truthfully advertising something they\u2019re trying to sell, and that\u2019s exactly what the old ordinance did.\u201d<\/div>\n<div><\/div>\n<div>In October 2023, Will was preparing for a move to the Philippines where he was going to teach English to school children. As part of the move, Will wanted to sell his 1987 Chevy Deluxe truck. After his online ads went nowhere, he put a \u201cfor sale\u201d sign in the window of the truck, which was legally parked on the street in front of his home, like it always was. But because of the \u201cfor sale\u201d sign, Will faced a criminal charge and a fine. So, in April 2024, he and IJ sued the borough over the ordinance.<\/div>\n<div><\/div>\n<div>\u201cI\u2019m glad the borough has done the right thing and repealed the law, so nobody else will have to worry about facing criminal charges for simply putting a \u2018for sale\u2019 sign in their car window,\u201d said Will. \u201cThis case was always about making sure what happened to me doesn\u2019t happen to anyone else in Nazareth.\u201d<\/div>\n<div><\/div>\n<div>Under the old law, had Will\u2019s sign been an advertisement for a business or a slogan for a political campaign or any other form of speech, that would have been perfectly legal. The only message that was illegal to display on a car was one that said \u201cfor sale.\u201d<\/div>\n<div><\/div>\n<div>\u201cIt was clear from the beginning that this ordinance criminalized some forms of speech while permitting others, which is a clear violation of the First Amendment,\u201d said IJ Senior Attorney Jeff Rowes. \u201cWe\u2019re very happy that Nazareth has acknowledged the flaws with this old law and gotten rid of it.\u201d<\/div>\n<div><\/div>\n<div>Nazareth\u2019s other parking rules, which do not regulate speech, remain on the books.
